Man admits attack in toilets

A MAN has admitted taking part in an attack in the toilets of a Shipston pub before the victim was then robbed by a second attacker.

Samuel Peebles, aged 25, of Berry Avenue, Shipston, pleaded not guilty at Warwick Crown Court to robbing Ieuan Smith in December last year, but admitted assaulting him.

Prosecutor James Dunstan said that Timothy Dyer, aged 20, of Pittaway Avenue, Shipston, who was also in the dock, had pleaded guilty at an earlier hearing to robbing Mr Smith of his wallet containing £120 in cash and various bank cards.

At that hearing the court was told it involved an attack on Mr Smith in the toilets of the George Hotel in Shipston.

After Peebles had entered his pleas, Simon Davis, for Dyer, pointed out that he had pleaded guilty on the basis that they had jointly been involved in the robbery.

But accepting Peebles's pleas, Mr Dunstan explained: "It reflects the full circumstances as set out by the victim in this case. He describes a joint enterprise assault, with kicking being involved, from two attackers.

"He does go on to say that he was robbed, but that alone might not be sufficient to prove there was a joint enterprise at that stage."

Judge James Pyke adjourned the case for a pre-sentence report to be prepared on Peebles. Both defendants were granted bail, but the judge told them: "Neither of you must draw any inference from the fact that you are being granted bail and that reports are being prepared."
