A 33-YEAR-OLD Tewkesbury man, who was convicted of failing to provide a specimen, will have his appeal heard on February 29, a court heard yesterday.
Stuart Gibbs, of Oldfield Road , appeared at Gloucester Crown Court for a brief mention hearing.
The court heard how the issue in the case would be whether there was a reasonable "medical reason" as to why he could not provide a specimen on August 27, 2006.
Mr Recorder Geoffrey Still set some further directions towards the appeal, which will be heard at Gloucester Crown Court, sitting at Cirencester on February 29.
Gibbs, who, the court heard, is currently serving a short sentence for another unrelated matter and is due to be released on Monday, was remanded in custody.
