A MAN who is in custody accused of burglary was not delivered to court - because prison authorities thought he was out on bail.

Sean Mayer, 31, of Davey Road, Northway, Tewkesbury, was supposed to be on prison transport from Hewell jail in the Midlands to Gloucester crown court today.

But he failed to attend and his defence lawyer told the court it was because prison authorities at Bristol had not appreciated he was in custody and thought he was on bail.

They had therefore not instructed Hewell to send him.

"The less I say about that the better," said Judge Jamie Tabor QC. "I thought we had got over these problems with Bristol."

He adjourned the case until January 17.

Mayer is accused of a burglary in Newtown, Tewkesbury.
